Supreme Court Rules Against The NCAA | Sports Takes & News | TooAthletic.com

On Monday, after generations of running college sports with an iron fist, the Supreme Court told the NCAA enough is enough by deciding the rules against college student-athletes making money from their abilities are over. While the NCAA did their best to spin the decision into exactly what they wanted from the highest court in the land, those within the sport called it what is was, a milestone victory for student-athletes and the first step towards reversing the decades of wrongs the NCAA imposed on college sports all in the name of their own profits. 

The first day of summer saw the United States Supreme Court inform the National Collegiate Athletic Association (NCAA) that rules limiting how many student-athletes could earn in “education related compensation” while attending their member schools were against the law. 

As part of the historic 9-0 unanimous ruling, Justice Brett Kavanaugh wrote:

“The bottom line is that the NCAA and its member colleges are suppressing the pay of student athletes who collectively generate billions of dollars in revenues for colleges every year. Those enormous sums of money flow to seemingly everyone except the student athletes.”

The ruling invoked a huge reaction Monday, with many from different walks of life speaking out in favor of it. United States Senator Chris Murphy (D-CT) said of the ruling:

“Today’s Supreme Court ruling highlights just how much the tide is turning against the NCAA and its unfair treatment of college athletes. The status quo on ‘amateurism’ is finally changing and the NCAA no longer has carte blanche to control athletes’ livelihoods and monopolize the market. This is the kind of justice, and basic rights, college athletes deserve.”

Jay Bilas, himself a former college basketball player and now a practicing lawyer and ESPN commentator, noted it was the NCAA who petitioned the Supreme Court to hear this case. Now, thanks to their poor leadership, the NCAA will likely face a mountain of lawsuits as the court pointed out that they are not above federal antitrust laws, something the ruling did not cover, but the court offered in their decision. 

As noted by the Associated Press, Monday’s ruling pertained to the limits placed upon student-athletes regarding computers, graduate scholarships, tutoring, studying abroad and internships can’t be enforced. Nevertheless, the days of college athletes being able to endorse companies while in school are fast approaching, something NCAA President Mark Emmert noted when he said:

“Even though the decision does not directly address name, image and likeness (NIL), the NCAA remains committed to supporting NIL benefits for student-athletes. Additionally, we remain committed to working with Congress to chart a path forward, which is a point the Supreme Court expressly stated in its ruling.”

The list of student-athletes from almost every sport who have been harmed by the rules the NCAA covers all walks of life from several generations. True, in some ways the benefits paid to players may be considered bribes by some, their “under the table” deals were precipitated by the iron clad rules the NCAA had preventing student-athletes from accepting an endorsement deal or even a decent paying job in order to cover expenses outside of their scholarships.
